Why it is important to fill the consent form to request GCMS Notes?

The necessity of a consent form arises due to the legal provisions outlined in the Canadian Privacy Act, which stipulates that the disclosure of personal information is prohibited unless explicit consent is obtained from the relevant individual.

By completing the consent form accurately, you can ensure the efficient handling of your order. To proceed, kindly print the form and affix your handwritten signature directly onto the document. It is essential that individuals aged 16 and above sign individually, using an official signature that matches the one on their passport.

Which specific consent form should be utilized?

Once the order form is duly completed and payment has been completed, a consent form tailored to your requirements will be sent to you via email.

Streamlined Consent Procedure: For requests involving information from both the Immigration, Refugees and Citizenship Canada (IRCC) and the Canada Border Services Agency (CBSA), you now have the convenience of utilizing a single consent form – the CBSA consent form. The IRCC consent form is not mandatory for dual agency notes, such as GCMS Notes from IRCC & CBSA, and Entire File from IRCC & CBSA.

Are electronic signatures considered valid?

It is acceptable to use a legible and accurate electronic signature that matches your handwritten signature as displayed on your passport. However, it is important to refrain from presenting a messy or illegible image of your signature, as it may be perceived as forgery. In such instances, we will kindly request that you provide a new consent form that exhibits a clear, concise, and authentic signature.

Regardless of whether you choose to sign the form by hand or electronically, it is essential that only the applicant themselves sign the document, and the signature should align with the official signature on the passport. By submitting a properly completed consent form along with your request, you can help prevent any unnecessary delays.

To submit the consent form, please utilize the form provided below, allowing for uploads of up to 5MB in PDF or Image format. It is crucial to ensure that the consent form is scanned at a high resolution to maintain clarity and legibility. Submitting unclear or distorted documents may lead to unwarranted delays in processing.

To ensure a comprehensive retrieval of records, it is highly recommended to obtain consent from all individuals whose information may be encompassed within the requested documents. This includes your spouse, sponsor(s), co-signor, and any family member, including children aged 16 years or older. In the case of minor children, the consent of both biological parents is necessary to authorize the release of their information. However, if a child is under the custody of a single parent or a third party, a valid copy of the custody agreement must be provided as proof. Failure to obtain consent from all relevant individuals may result in the government institution withholding information pertaining to those without consent.

By submitting a well-documented application accompanied by consent from all applicable individuals, you can maximize the amount of information provided in response to your request. Otherwise, certain information within the files may qualify for exemption under section 19 of the Access to Information Act.

While not mandatory, including a copy of the passport biographical pages (i.e., photo and signature pages) for all applicants can greatly assist the government institution in expediting the processing of your request. This documentation can be submitted along with the consent form.

The visa status or application of the other individuals, or the necessity of their files, is not pertinent in this matter. Many applicants tend to misunderstand this requirement, and failure to obtain consent from all relevant parties can result in delays, as additional efforts are needed to eliminate any references to individuals without their consent from your file. Complying with these guidelines is crucial to ensure adherence to Canadian privacy regulations and avoid unnecessary complications.
